Terms of Service

These Terms of Service (“Terms”) govern your access to and use of mybahay.app (the “Service”) operated by myBahay (“we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Homeowner Accounts

• The first year of service is provided at no charge when your account is set up by a participating real-estate agent.
• After Year 1, continued use is billed at $100 per year. We will give you at least 30 days’ notice before any charge.
• You may cancel at any time. No partial-year refunds are issued after a billing period begins.
• You are responsible for the accuracy of the property data you enter.

2. Agent Accounts

• Agents pay a one-time $100 setup fee per homeowner, charged via Stripe at the time of submission.
• Refunds are available within 48 hours of payment if we have not yet begun the homeowner setup. After setup begins, the fee is non-refundable.
• By submitting a homeowner’s information you confirm you have the homeowner’s explicit permission to do so.
• Agents must not submit false or fabricated property information.

3. Acceptable Use

You agree not to:

• Share your account credentials with others.
• Enter false, misleading, or fraudulent property or maintenance data.
• Scrape, crawl, or programmatically extract data from the Service without our written permission.
• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to interfere with or compromise the security or integrity of the Service.

4. Intellectual Property

myBahay owns all rights to the platform, including software, design, and trademarks. You retain ownership of the property data you submit. By using the Service you grant us a limited license to store and display your data solely to provide the Service to you.

5. Disclaimer of Warranties

The Service is a reminder and record-keeping tool only. It is not a home inspection service, warranty program, or professional advisory service. We make no representations about the completeness or accuracy of maintenance recommendations. The Service is provided “as is” and “as available” without warranties of any kind, express or implied.

6. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising out of or related to these Terms or the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

7. Termination

We may suspend or terminate your access if you violate these Terms. You may delete your account at any time from account settings. Upon termination, your property data will be purged within 90 days per our Privacy Policy.

8. Governing Law

These Terms are governed by the laws of the State of [Mat's state], without regard to its conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in [Mat's county] County, [Mat's state].

9. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
